Nicholas Zaffarese sued Iona College after he allegedly contracted a bacterial infection while using the school's athletic facilities.
When the Westchester County Supreme Court granted Iona's dismissal request, Zaffarese appealed to the Appellate Division, Second Department.
The AD2 didn't think Iona needed to maintain bacteria-free facilities or screen for its presence nor was it obligated to instruct students on ways to avoid getting an infection.
But that part of Zaffarese's case which alleged Iona knew of the bacteria's presence and failed to take appropriate corrective measures was allowed to fester.
