Sharon H. filed suit to regain custody of her two children who had been placed in foster care.
While Sharon took classes to show she was prepared to address her youngsters' emotional and medical needs, the Children's Aid Society (CAS) established that the mother hadn't adequately planned for her children's return.
After the New York County Family Court terminated Sharon's parental rights based on "permanent neglect," custody was transferred to CAS and to New York City Commissioner of Social Services so the children could be released for adoption.
On appeal, the Appellate Division, First Department, agreed Sharon hadn't properly prepared for her kids' emotional needs and that termination of her parental rights was in the children best interests.
