In Matter of Miles v. Commissioner of Labor , Stacy Miles was fired from her job at a New York City college because she refused to accept a new position.
Stacy had been reassigned to the student enrollment services counseling center from the affirmative action office and viewed the reassignment as a punishment for complaining about the college's president.
The New York State Unemployment Insurance Appeal Board determined Stacy wasn't entitled to unemployment insurance benefits because her employment was terminated due to "misconduct." On appeal, the Appellate Division, Third Department, affirmed the outcome because the reassignment wasn't improper and the declination justified her discharge.
