"MY, GRANDMA ...."

redridinghood.JPGIn Matter of Couse v. Couse , Peggy Couse's parents wanted to visit with their grandchildren and asked the Chenango County Family Court for assistance. When that court denied their request, and indicated they would only be entitled to that relief once their daughter died, an appeal to the Appellate Division, Third Department, followed.

The AD3 didn't think the grandparents needed to wait for their daughter's death. Rather, they had to show "circumstances in 'which equity would see fit to intervene.'"

In this case, the AD3 concluded that the Family Court should have examined whether it was in the children's best interests to give the grandparents visitation rights.
