j0406486.jpgIn Matter of Rivera v. Leclaire , Jose Rivera -- a prison inmate -- was charged with violating a prison disciplinary rule when he was caught entering the prison yard with "numerous items concealed in towels and clothing in the bottom of his net bag."

After the Superintendent of the Eastern Correctional facility found him guilty, he filed a special proceeding with the Ulster County Supreme Court which transferred the matter to the Appellate Division, Third Department.

Based on a detailed misbehavior report filed by a correction officer, coupled with Rivera's own admission that he attempted to bring the items into the prison yard, the AD3 confirmed the superintendent's determination based on the "substantial evidence" which supported the outcome.

The AD3 certainly smuggled that.
