In People v. Soberanis , Marvin Soberanis was convicted of criminal possession of a weapon in the second and third degrees.
While Marvin's use of his firearm against an armed assailant was justifiable, his possession of the weapon was illegal.
After the New York County Supreme Court sentenced Marvin to concurrent terms of 12 and 7 years, he appealed to the Appellate Division, First Department, which could discern nothing wrong with the evidence, the jury instructions, or his counsel's performance.
How sobering. (At least he took a shot)
