HOW CORRECT WAS CORRECTIONAL SERVICES?

j0178075.jpgIn Matter of Adams v. Selsky , James Adams -- a prison inmate -- was charged with violating three disciplinary rules.

Accused of assault, weapon possession, and fighting after stabbing another inmate in the neck, the weapon Adams supposedly used was found on the floor (in his vicinity) and the sheath was discovered in his pants pocket.

The incident was witnessed by a correction officer who filed a "misbehavior report" detailing the incident.

After the Albany County Supreme Court found Adams guilty of assault and weapon possession, he appealed to the Appellate Division, Third Department.

Because the misbehavior report and the correction officer's corroborating testimony provided sufficient evidentiary support for the administrative determination, the AD3 upheld the outcome.

Obviously, Adams wasn't correctionally correct.
