TEMPORARY RELOCATION AIN'T "ABANDONMENT"

j0433158.jpgIn Prominent Assets LLC v. Little , Prominent filed a holdover proceeding against Hugh Little, claiming that he no longer used his rent-stabilized apartment as his principal or primary residence.

After the New York City Civil Court found in Little's favor, Prominent appealed to the Appellate Term, First Department.

The AT1 found Little hadn't abandoned his unit when he "temporarily relocated to care for a mentally ill friend" who had attempted suicide. The record established the tenant intended to return to the apartment and, in fact, did so.

Not very prominent.
