j0428532.jpgIn Matter of Derrick C. v. Deanna G ., Deanna G. challenged an order which found she neglected her son and derivatively neglected her daughters because she continued to live with the children's father and failed to admit he sexually abused their son -- even after the man pled guilty to "sexual abuse in the first degree" for touching their son's penis.

When the Jefferson County Family Court removed the children from her custody, placed them in their maternal grandparents' care for one year, and, directed Deanna be subject to supervision by the Jefferson County Department of Social Services , she appealed to the Appellate Division, Fourth Department.

The AD4 was of the opinion the evidence supported the outcome. Deanna "'demonstrated a fundamental defect in [her] understanding of the duties and obligations of parenthood and created an atmosphere detrimental to the physical, mental and emotional well-being of [her two daughters].'" It also upheld the Family Court's requirement Deanna admit she played a role in her son's sexual abuse as a condition of her supervision.
