SPITZER KIBOSHES RSC AMENDMENTS

According to the RSA Reporter -- a publication distributed by the Rent Stabilization Association of N.Y.C., Inc. -- Governor Spitzer's administration ordered the State Division of Housing and Community Renewal (DHCR) to pull some amendments slated to be adopted on January 3, 2007 (only days after our new Governor was sworn into office).

Here are just a few of the changes that had been contemplated:

  • permitting owners to commence non-primary residency proceedings against their rent-stabilized tenants at any point during a lease (rather than at the end of an existing lease term, subject to the service of a notice of non-renewal issued 90-120 days prior thereto);
  • increasing the amount of a security deposit collectible from new tenants to two months' rent (rather than the current one-month standard);
  • clarifying that termination (or "non-cure") notices served upon regulated tenants did not need to have an additional five days added to the governing time-frame in the event they were sent by mail; and
  • affording owners a 1/40th rent increase for lead-based paint abatement in common areas and individual apartments.

Does this move signal a "pro-tenant" administration is now in power?
