THEY’RE NOT VERY HOSPITABLE AT JACOBSON MEMORIAL HOSPITAL

COMPLAINT ABOUT “N-WORD’s” USE GOT THIS EMPLOYEE FIRED

After a co-worker called her the “n-word,” the victim (a Black nursing aide) was fired after notifying her employer – Jacobson Memorial Hospital Care Center -- of the misconduct.

Believing that such conduct violated Title VII of the Civil Rights Act of 1964, the U.S. Equal Employment Opportunity Commission (EEOC) filed a retaliation lawsuit (EEOC v. Jacobson Memorial Health Care Center, Inc.), Case No. 1:23-cv-00192-DMT-CRH), in U.S. District Court for the District of North Dakota, seeking monetary damages and injunctive relief.

In a recently announced settlement, the hospital has agreed to pay the impacted individual $45,000 and will modify its employment and training practices.

By way of an accompanying statement, Gregory Gochanour, regional attorney for the EEOC’s Chicago District, noted that, “Title VII protects an employee’s right to speak out when they experience discrimination or harassment. The EEOC is pleased that the nursing aide has been compensated and that Jacobson has agreed to the non-monetary relief set out in the consent decree to prevent racial harassment and retaliation in the future.”

No negating “n-word’s” utterance there ….
