After the New York County Supreme Court denied Plaintiff E’s request for an order of “seizure, preliminary injunction, and temporary restraining order,” all with respect to the parties’ canine, an appeal followed.

Given that the motion court had properly found it was in the “best interests for all concerned,” that the 13-year-old animal not engage in back-and-forth travel to Nashville, and that it remain in New York, with Defendant M, the Appellate Division, First Department, left the denial undisturbed.
