FATHER FOUND TO HAVE NEGLECTED CHILDREN

COMMITTED MULTIPLE ACTS OF DOMESTIC VIOLENCE IN FRONT OF HIS KIDS

After he was found by the Queens County Family Court to have neglected his children, the father appealed. And on its review of the case, the Appellate Division, Second Department, noted that (in his kids’ presence) the guy had “threatened to hit the mother with a clothing iron, and struck her in the face with his hand and caused her to fall on the ground.”

The Administration for Children's Services also presented evidence that the dad had exhibited “violent behavior,” observed by the youngsters, in two other instances.

Since the “preponderance of the credible evidence” reinforced that the “physical, mental, or emotional condition of the children was impaired or was in danger of becoming impaired by the father's acts of domestic violence against the mother in their presence,” the AD2 left the outcome undisturbed.
