A.G. Schneiderman Announces Trial Conviction Of Former Nursing Home Counselor For Sexual Abuse Of Residents Who Suffered From Traumatic Brain Injuries
Jacky Stanley Convicted Of Using Authority Over Victims To Commit Sex Crimes; Will Face Up To 8 1/3 To 25 Years In Prison
KINGSTON—Attorney General Eric T. Schneiderman recently announced the conviction of Jacky Stanley, a former employee of Northeast Center for Special Care in Lake Katrine for sexually abusing six residents of the facility, each of whom were in the facility to rehabilitate after suffering traumatic brain injuries. Stanley will face up to 8 1/3 to 25 years in prison. The six victims of Stanley’s abuse all testified in court; Stanley was convicted of crimes relating to each victim.
“Jacky Stanley used his position as a caretaker to commit reprehensible and disturbing acts of abuse. The bravery shown by his victims at trial will help ensure that he will never be able to terrorize vulnerable New Yorkers again,” said Attorney General Schneiderman. “We must continue to ensure that health care facilities are safe places where families can rest assured that their loved ones will be treated with respect and dignity. My office will prosecute these types of criminals to the fullest extent of the law and fight for justice for the victims of their abuse.”
Northeast Center for Special Care provides care and rehabilitation to individuals who have suffered traumatic brain injuries caused by stroke, motor vehicle accidents, falls, and other catastrophic events. Stanley was employed as a counselor at Northeast and was responsible for helping new residents acclimate to the Center. Stanley’s duties, as a “Neighborhood Counselor” included managing the residents’ social environment and ensuring that residents participated in their required programs.
As prosecutors proved, between July 2014 and February 2015, Stanley used his position to gain access to residents multiple times and forcibly performed sex acts, including oral sex; in February 2015, Stanley used his entrusted position to abuse another resident while the resident slept. Stanley was suspended and then terminated from the facility based upon allegations of sexual abuse. Stanley was arrested in July 2016 and indicted by the Ulster County grand jury in August 2016 on multiple felony charges, including Criminal Sexual Act in the First Degree, Sexual Abuse in the First Degree, and Endangering the Welfare of an Incompetent or Physically Disabled Person in the First Degree.
Hon. Donald A. Williams presided over the jury trial in Ulster County Court in Kingston.
Stanley, 50, of Kingston, was convicted of one count of Criminal Sexual Act in the First Degree, a class B felony, seven counts of Sexual Abuse in the First Degree, a class D felony, and 16 counts of lesser charges. Sentencing will occur on July 28.
The Attorney General thanked the Town of Ulster Police Department, particularly Detectives William Moylan and Joshua Normann, for their work on the investigation and the Northeast Center for Special Care for its cooperation.
The trial was conducted by Assistant Attorneys General William McClarnon and Catherine Slattery of the Attorney General’s Medicaid Fraud Control Unit, Pearl River Regional Office, under the supervision of Regional Director Anne Jardine and Thomas O’Hanlon, MFCU’s Chief of Criminal Investigations–Downstate. The investigation was led by Sr. Investigator Frank Bluszcz and Inv. Peter Olsen with the assistance of Medical Analyst Margaret Walsh, RN, staffers Michele Keeley and Caroline Lindemann, Supervising Special Investigator Peter Markiewicz, and Deputy Chief Investigator Kenneth Morgan.
The Medicaid Fraud Control Unit investigates abuse and neglect of patients in residential healthcare facilities in addition to provider fraud against the Medicaid Program. Director Amy Held and Assistant Deputy Attorney General Paul J. Mahoney lead MFCU. The Division of Criminal Justice is led by Chief Deputy Attorney General Jason Brown.
