WHITE PLAINS, THERE'S A PROBLEM

ME reveals contradictory report in Kenneth Chamberlain Sr. case

WHITE PLAINS - A medical examiner’s report seems to contradict what has been previously said about events leading up to the police shooting of Kenneth Chamberlain Sr. in 2005.

Westchester medical examiner Dr. Kunjlata Ashar performed the autopsy on Kenneth Chamberlain Sr. following his death, and testified that in addition to the fatal gunshot wound, she found four other non-fatal beanbag shot impacts on his body, including one unreported shot to his back.

Prior to this testimony, every White Plains police officer on the scene, including defendant Police Officer Anthony Carelli, testified that Chamberlain was facing police at all times during the violent November 2011 standoff with police.

Authorities were called to Chamberlain’s apartment after his life alert device accidentally went off. Officer Carelli shot Chamberlain, claiming that Chamberlain lunged at another officer with a knife.

The attorney for Kenneth Chamberlain Jr. in the civil trial said the "blockbuster testimony" on Tuesday proves Chamberlain was not trying to hurt police when he was killed.

Chamberlain Jr. is suing Carelli and White Plains for $21 million because he believes his father's shooting was unjustified.

On Tuesday, his legal team suggested that Chamberlain was on the ground when officers shot him, but the medical examiner testified she couldn't tell exactly where in the apartment Chamberlain was shot, or if he was standing or on the ground.

Closing statements are expected on Wednesday.
