LACKING CONSTITUTION?

B. Lewis filed suit against PSCH -- a private, non-profit corporation -- alleging that it violated her First and Fourteenth Amendment rights when it fired her.

After the Kings County Supreme Court dismissed her case, Lewis appealed and the Appellate Division, Second Department, agreed that the non-profit wasn’t acting “under the color of state law” when it ended her employment.

That was some constitutional.
