COULD YOU GET ANY LOWER?

When Tewan Lowe pulled his bus up to a designated stop, an irate passenger supposedly said to him, "[I] should shoot you," and "[I] should come back and shoot you."

After Lowe called the police, Noha S. was arrested and later convicted by the Kings County Criminal Court of two counts of harassment in the second degree.

Since Noha's statements didn't present "a genuine and immediate threat to the driver," the Appellate Term, Second Department, vacated the conviction which related to Mr. Lowe. But because she threw punches and injured an officer during the course of the investigation, the second harassment count was allowed to stand.

How wise was that, Noha?
