ACKNOWLEDGE THIS!

Claiming that her prenuptial agreement was improperly acknowledged, and thus unenforceable under New York law, Michelle Galetta asked the Monroe County Supreme Court to invalidate the document. While that court and the Appellate Division, Fourth Department, both denied that request, our state's highest court viewed the case a bit differently.

Apparently, the agreement left out key language as to whether the notary confirmed Gary's identity or witnessed his signature. And although Gary tried to correct that deficiency after-the-fact, by introducing a sworn statement by the notary in question, the New York State Court of Appeals rejected that submission--because the affidavit vaguely alluded to the notary's "custom and practice" rather than address the specific situation.
