1. Employers with 5 or more employees who are hired to work more than 80 hours per calendar year
in NYC must provide paid sick leave.

2. Employers with 1–4 employees who are hired to work more than 80 hours per calendar year in NYC
must provide unpaid sick leave.

3. Employees can use sick leave to care for themselves or a family member, including a child, grand-child, spouse, domestic partner, parent, grandparent, child or parent of a spouse or domestic partner, or sibling (including half, adopted, or step sibling).

4. Employers must give the Notice of Employee Rights created by the Department of Consumer Affairs (DCA) to new employees when they begin employment and to existing employees by May 1, 2014.

5. Employees earn up to a maximum of 40 hours of sick leave per calendar year.

6. Employees accrue sick leave at the rate of 1 hour for every 30 hours worked.

7. Existing employees begin accruing sick leave on April 1. New employees begin accruing sick leave on the frst day of employment.

8. Existing employees can begin using accrued sick leave starting July 30. New employees can begin using accrued sick leave 120 days after the frst day of employment.

9. Employers who have 1 or more domestic workers who have been employed at least 1 year and who work more than 80 hours a calendar year must provide 2 days of paid sick leave. City leave is in addition to the 3 days of paid rest to which domestic workers are entitled under NYS Labor Law.
Accrual and use of sick leave for domestic workers follows NYS Labor Law.

10. The law sets the minimum requirements for sick leave. An employer’s leave policies may already meet or exceed the requirements of the law.
