After the Bronx County Family Court found that Santiago had "abandoned" his kids and that Colleen had "permanently neglected" them, the couple's parental rights were terminated and the youngsters were placed with a foster care facility.

On appeal, Santiago claimed that he had asked Colleen to convey his love to the kids when she made her visits, and further noted that he had paid for most of the gifts she would bring to the youngsters--like candy, juice, shoes, and toys. But, not only were those assertions "unsubstantiated," Colleen offered only "uncorroborated and inconsistent excuses" for her failure to complete counseling or to secure "suitable housing." So, ultimately, the Appellate Division, First Department, agreed that the placement was in the children's "best interests."
