After starting a mortgage foreclosure action, Washington Mutual Bank asked that J.P. Morgan Chase be substituted in its place and stead and that a default judgment issue against Navid Hakimian (and others).

While the Nassau County Supreme Court allowed the substitution, it refused to issue a judgment because the bank hadn't shown an entitlement to that relief.

Apparently, J.P. Morgan couldn't provide an affidavit by an individual with "personal knowledge of the material facts." The court also questioned the admissibility of the underlying loan documents because they weren't J.P. Morgan's "business records."

Knowledge can be so empowering.
