Piedmont Land and Cattle hired W.D. Bach Excavating & Consulting to demolish a parking lot and "fill in all voids and holes."

When Cameron Paro later fell and filed a personal injury case against the owner, Piedmont claimed Bach was responsible for the injuries and brought a case against the contractgor.

While the Jefferson County Supreme Court granted Bach's request to have that third-party case dismissed, the Appellate Division, Fourth Department, reinstated that dispute because it thought there were "issues of fact" as to whether Bach had exercised "reasonable care" and whether its work had exacerbated the property's condition.

No harmony for that Bach.
