Ellwood Realty wanted access to Milliely Nieves "Facebook" account after the youngster sued to recover damages for her physical and psychological injuries. (Milliely claimed to suffer from, among other things, anxiety, depression, and posttraumatic stress disorder.)

When the New York County Civil Court granted Ellwood's request, the kid appealed to the Appellate Term, First Department, which modified the order and directed that only those entries made after the accident needed to be supplied. And, because it recognized that not all of the posts might be pertinent to the case, the appellate court directed that a judge look at the data (so that only the relevant entries would be released).

No about-face there?
