George Fraumeni sued Dr. Anthony Perugini for malpractice after another dentist reportedly informed Fraumeni that a root canal hadn't been properly performed and that additional work was necessary. But when the case got tossed because it had been filed too late, Fraumeni appealed.

Because Dr. Perugini established that his work was completed more than 2 years and 6 months prior to the start of the lawsuit, the Appellate Division, Second Department, agreed that the litigation was time-barred by state law. (A phone conversation wherein Perugini disagreed with the other dentist's recommendations and the patient's "numerous attempts" to get the original doctor to do the additional work weren't enough to get around that cut-off.)
