Claiming that their mother had breached her fiduciary duty as trustee of their trusts (and wasn't complying with the governing terms), two kids filed suit.
While the Erie County Surrogate's Court sided with the young ones, the Appellate Division, Fourth Department, didn't think there had been any violation or breach, as the trusts gave the mother considerable latitude when it came to dispersing the proceeds.
