KNUTT CASE

nutcracker_photo_nyreblog_com_.JPGAfter the Metro -- a free daily newspaper -- published "John" Knutt's picture under a headline which read "Call to Get Tougher on Gang Activities," the ten-year-old and his parents filed a defamation case against the publication.

While the Kings County Supreme Court threw the case out, the Appellate Division, Second Department, thought the placement of the kid's photo could have left people with the impression that the youngster had something to do with a serious crime--which might have injured his reputation. It also thought the question of whether Metro acted in a "grossly irresponsible manner" needed to press forward.

They sure ganged up on Metro.
