cemetary_gravestones_graveyard_photo_nyreblog_com_.jpgHelen Brandenburg sued for emotional distress when she discovered that St. Michael's Cemetery had mistakenly placed her husband's body in the wrong crypt and then later moved the remains to the correct location--all without prior notice to her.

Both the Queens County Supreme Court and the Appellate Division, Second Department, offered little sympathy because Ms. Brandenburg hadn't shown that the cemetery had "mishandled" or "desecrated" the body during the relocation process. (The AD2 also cited to the absence of any "malice or wantoness" on the Cemetery's part.)
