Bill Modernizing Attorney Liens Signed Into Law
Governor Cuomo yesterday signed into law S.1546 (Sampson) / A.5275 (Titone). NYSTLA strongly supported this bill as it moved through the legislature and ultimately to the Governor's desk. We would like to thank our members, leadership and lobbyists for their efforts to enact this important modernization of the laws governing attorney liens.
The law, which comes into effect on January 1, 2013, amends the Judiciary Law to allow attorneys to attach a charging lien to the proceeds of any recovery obtained as the result of arbitration, mediation, or any pre-litigation negotiated settlement. As arbitrations, mediations and other forms of alternative dispute resolution become increasingly common, this law will help protect attorneys' right to compensation.
