Even though they shared custody of their four children, it was agreed that the youngsters would live with Racquel in North Carolina. A few years later, Blerim asked the Bronx County Family Court for full custody and, after that request was granted, Racquel appealed.

Since she had home-schooled the kids (over the father's objections), interfered with his visits, and told the children to keep their dad in the dark about anything that was happening to them, the Appellate Division, First Department, found the modification of the custody arrangement justified.

The Court also noted that the children had allegedly been abused (by Racquel's friends) and lagged behind their peers academically (because Racquel wasn't equipped to home-school them).
