After their washing machine flooded her condo, Gina Delgardio sued Jose & Betty Davis (the unit's owners) and Island Condo Management Corp.
And when the Richmond County Supreme Court refused to let Island out of the case, the company appealed.
Since it was able to show it didn't have a duty to maintain the Davis's apartment, nor used, owned or controlled that space, the Appellate Division, Second Department, found the company free of any liability.
