LET'S PLAY THE BLAME GAME...

stock_trading_wall_street_photo_nyreblog_com_.JPGAfter he was found to have violated multiple New York Stock Exchange and Securities Exchange Commission rules while working as a "floor trader," James O'Callaghan filed a malpractice claim against his attorney for failing to call a specific witness during the course of a disciplinary proceeding.

O'Callaghan believed that had it not been for his attorney's negligence the charges against him would have been dismissed. However, the New York County Supreme Court didn't agree and ended up throwing the case out.

Without a showing that his attorney's error caused the underlying outcome, the Appellate Division, First Department, agreed that the malpractice case wasn't maintainable.
