TOWER OF ERROR?

termite_cartoon_nyreblog_com_.JPGDouglas Dean didn't move into his new home because it was infested with termites, and "major renovations" had been required to rectify the problem.

When his insurer, Tower Insurance Company, denied a reimbursement claim--because he never took possession of the property--Dean filed suit and the New York County Supreme Court ended up siding with the company.

Since it was unclear whether Dean had to live in the space for coverage to apply, and whether the guy had misrepresented his intentions about living in the home, the Appellate Division, First Department, reversed and reinstated the case so that these questions could be resolved at trial.

That would have bugged me.
