When the Suffolk County Supreme Court denied the defendants' dismissal request, they appealed.

While horseback riding can be dangerous, the Appellate Division, Second Department, thought the defendants failed to show that the youngster--who had "limited riding experience"--fully appreciated the risks involved.

They must be champing at the bit.
