David Arredondo filed suit after he suffered burns while repairing Robert Valente's vehicle. (Apparently, Arredondo was given a defective torch by Valente.)

Although the Queens County Supreme Court was reluctant to dismiss the litigation, the Appellate Division, Second Department, didn't quite warm up to the case.

Because Arredondo testified that the torch had been working properly, and since he couldn't provide the court with any evidence that Valente knew the equipment was defective, the AD2 opted to reverse and dismiss.

Will he fire back?
