While in a dog park, Julie Sullivan's goldendoodle, collided with Susan Hamlin, sweeping the latter off her feet and causing her to fall.

When Hamlin later sued, the Saratoga County Supreme Court denied Sullivan's request to have the case thrown out. But on appeal, the Appellate Division, Third Department, noted that while pet owners are responsible for the injuries their animals cause when they know of their animals' "dangerous proclivities," because there was no evidence that this particular dog had harmed anyone in the past, no liability for the incident could attach.
