After the New York City Housing Authority ("NYCHA") terminated her tenancy (based on "nondesirability" and breach of the NYCHA's rules and regulations), Theresa Lemmitt filed an administrative proceeding challenging that outcome.

Because an informant claimed to have purchased drugs from one of Lemmitt's friends, officers searched the residence, found drugs and related paraphernalia, and arrested the tenant and others who were in the apartment at the time of the raid.

Since the drug activity, and the presence of an unauthorized "guest," violated an agreement Lemmitt had reached with NYCHA prior to the arrest, the Appellate Division, First Department, let the termination stand.

"Lahdle-ahdle-ahdle-dig-dig-dig."
