JUSTICE IN FULL SWING?

baseball_female_athlete_photo_nyreblog_com_.jpgWhen Chelise Navarro won her personal-injury case, the N.Y.C. Department of Education asked the Bronx County Supreme Court to vacate the jury's verdict and appealed when its request was denied.

Since she was injured by a classmate's swinging bat during the course of an "elective high school softball class," the Appellate Division, First Department, thought that Navarro had assumed the risks usually associated with the activity, and dismissed the case.

No softballs there.
