BEYOND REPAIR?

psychiatrist_cartoon_nyreblog_com_.jpgAfter his son supposedly tried to harm him (and damaged the family home), Joseph Anella decided to leave his house to his daughter.

When Joseph later passed away, and the King's County Surrogate Court admitted the father's will to probate over Joseph, Jr.'s objections, the latter appealed.

Because his sister provided a psychiatrist's report together with affidavits by witnesses, including the attorney-drafter of the will, and family members and friends--all which reinforced the father's intentions and competence--the Appellate Division, Second Department, agreed that the will contest was without legal basis. (It also didn't believe that  the daughter had asserted any "undue influence" over her dad, even though she was his caretaker.)
