BACKING OUT

chiropracter_with_patient_photo_nyreblog_com_.JPGAfter she injured her back, Claudia Evart's doctor referred her to Park Avenue Chiropractics where Doctors Jacobs and Marsillo allegedly made the woman's condition worse.

While a New York County Supreme Court jury initially found that the chiropractors didn't injure Evart, Evart's attorneys convinced the trial judge to specifically ask the jurors if the woman had been advised of the risks associated with the procedure utilized. And the jury came back with a response that she hadn't.

After a verdict in Evart's favor was reached, the trial judge set aside the outcome and dismissed the case. Even if the lady hadn't been fully informed of the procedure's risks, since the doctors didn't cause her any harm, the Appellate Division, First Department, agreed that the verdict couldn't be sustained and that the case warranted dismissal.

Bet she needed an adjustment after that.
