H&V Singh were accused of breaching a "substantial obligation" of their tenancy because they allowed their two service dogs to roam around unleashed.

After their landlord started a summary holdover proceeding against them, the New York County Civil Court directed that dogs be removed or the Singhs would suffer an eviction.

On appeal, the Appellate Term, First Department, agreed that tenant misconduct had occurred but, in order to keep their apartment, the Singhs only needed to keep their animals tethered.
