After he was bitten by a dog, Andrew Ayres sued Pompeyo Martinez, the animal's custodian.
When the Kings County Supreme Court refused to dismiss the personal injury case, Martinez appealed.
Because there was no evidence the animal had ever been "aggressive, growled, bared his teeth, bitten anyone, or exhibited any other signs of viciousness," the Appellate Division, Second Department, opted to reverse and end the litigation.
That case truly lacked teeth.
