Felix Paris sued to recover a security deposit and a rent overpayment given to Yewande Oyesanya -- the owner of a Section 8 apartment.
Oyesanya countered that Paris used the apartment for three months without paying the rent due.
Following a trial, the Kings County Civil Court found in Paris's favor and awarded him a money judgment in the amount of $910.
On appeal, the Appellate Term, Second Department, thought the lower court had been a bit too generous with Oyesanya's money.
While a Section 8 tenant is typically required to pay the entire rent due after a lease has expired, Paris and Oyesanya had supposedly reached an agreement which allowed Paris to continue paying the reduced Section 8 rate.
Ultimately, since the tenant vacated in the middle of the month, the AT2 believed that Paris was only entitled to a credit of $169.60.
