On behalf of the New York Law School Moot Court Association and the entire New York Law School community, we cordially invite you to serve as a judge of the 34th Robert F. Wagner National Labor & Employment Law Moot Court Competition. The Wagner Competition is the nations largest student-run moot court competition and the only national competition dedicated exclusively to the areas of labor and employment law.
The fact pattern this year presents two labor and employment law issues. The first issue explores the circuit split regarding what constitutes a prima facie case for a plaintiff terminated in a general reduction in force under the Age Discrimination in Employment Act (ADEA). The second issue addresses whether an undocumented alien employee may recover under the ADEA, in light of the Supreme Courts holding in Hoffman Plastic Compounds, Inc. v. NLRB, which held that federal immigration policy prevented the National Labor Relations Board from awarding back pay to an undocumented plaintiff, even if the employer violated the National Labor Relations Act. The fact pattern outlining these issues was released to competitors and judges on January 11, 2010, and is available at www.nyls.edu/wagner .
Specialized knowledge of labor and employment law is not necessary to volunteer as a judge in this competition. As the competition nears, judges will receive a copy of a bench brief that will provide them with all necessary information.
In addition to engaging with students from more than forty-five law schools and emergent legal issues, you may also obtain up to two Continued Learning Education (CLE) credits, one for each round you judge. We can only grant a maximum of two CLE credits per person, but welcome your participation in as many rounds as you would like to attend.
