AN UNSUCCESSFUL SUCCESSION CLAIM

00448714.jpgAfter Margaret Healey, the rent-stabilized tenant-of-record of an apartment owned by 72A Realty Associates, permanently moved to Los Angeles, her roommate claimed an entitlement to succeed to the unit.

When the landlord later filed a holdover proceeding, the New York County Civil Court denied the landlord's request for relief in its favor.

On appeal, the Appellate Term, First Department, thought that Healy's roommate hadn't shown she had lived with the tenant-of-record, for a two year period preceding the latter's departure, as required by law (Rent Stabilization Code [9NYCRR] ยง2523.5[b][1]).

Time didn't Healy that.
