Leonard Simmons filed a personal injury case against the New York City Transit Authority (NYCTA).
After the Bronx County Supreme Court awarded relief in Simmons's favor, NYCTA appealed to the Appellate Division, First Department.
Since he failed to show he had suffered a "serious" injury, the AD1 reversed and dismissed the case. (Simmons's limited ability to play pool and lift heavy objects wasn't enough to support an award in his favor.)
Now that's serious.
