In Braun v. Sid's 2nd Ave. Bike Shop, Inc. , Supreme Court Justice Richard F. Braun sued Sid's Bicycle Shop for injuries caused by a defectively made bicycle.
After his lawsuit was filed, Braun sought to change the case's "venue" -- or location -- from New York County to Kings County, in order "to avoid the appearance of impropriety." Another New York County Supreme Court Justice sided with Braun, and granted that request.
On appeal to the Appellate Division, First Department, Sid's Bicycle Shop asserted that if a change was necessary, the location should be a county outside of New York City -- since Braun supposedly had relationships with other local judges.
The AD1 agreed and transferred the matter to Westchester County.
But is Westchester really that remote?
