j0262539.jpgAlthough Chandel B., Sr. claimed his consent was required before his child -- Chandel B. -- could be adopted, the New York County Family Court disagreed, and awarded custody of the minor to Social Services.

On appeal, the Appellate Division, First Department, noted a father's consent isn't required when the evidence shows that individual hasn't maintained "substantial and continuous or repeated contact with the child."

Since Sr. admitted he had offered no financial support, didn't make an effort to meet with or contact the child, and failed to oppose the neglect proceedings, the AD1 was of the view it was in the "child's best interest to free him for adoption."

We're letting that one go.
