j0402476.jpgKelli Horton's employment agreement with Concerns of Police Survivors, Inc. (COPS) provided that all disputes were to be decided in the State of Missouri.

When the Dutchess County Supreme Court refused to dismiss the contract-breach case (based on the forum selection provision), COPS appealed to the Appellate Division, Second Department.

Even though Horton was a single mother who resided in Dutchess County, New York, that wasn't enough to support the denial of COPS ' request.

According to the AD2, Horton needed to show that a trial in Missouri would pose "grave difficulty" or would somehow work to deny her due process.
