SMOKER'S LICENSE REVOKED

Getting a license to carry a gun in this town is virtually impossible. So why would someone risk losing it for a little M.J.? (And folks, we're not talking Michael Jackson!)

Ask Albert Esposito, who had his license to carry a pistol revoked after he was arrested for multiple counts of marijuana possession.

In Matter of Esposito v. Kelly , both the License Division of the New York City Police Department  and the New York County Supreme Court found that Esposito had violated the conditions of his gun license by failing to notify the License Division of his arrest.

On appeal, the Appellate Division, First Department, refused to disturb the revocation and noted that the outcome wasn't extreme or shocking under the circumstances.

With that, Esposito's gun license went up in a toke.
