WHERE DID SHE LEAVE HER HEART?

Susan Bennet filed for divorce in Saratoga County Supreme Court, but her husband, Jeffrey Bennet, wanted a "change of venue" to St. Lawrence County.

After the Saratoga County Supreme Court denied Jeffrey's request, he appealed to the Appellate Division, Third Department, which affirmed.

When there's a venue conflict -- that is, a disagreement as to where a case should be heard -- a court has the power to select a location appropriate "to at least one of the parties or claims."

While St. Lawrence was where Jeffrey resided, and where the couple's marital residence was located, Saratoga was where Susan worked and where their son attended school. Susan's driver's license, tax returns, vehicle registration and insurance identification, along with various bills all reflected that her primary residence was in Saratoga County.

Now that the AD3 denied Jeffrey's appeal, who will be making the next move?
